1. The bicycles and rented equipment will be delivered and collected at the location agreed upon by both parties, on the date and at the established time. Failure to return the equipment on the date stipulated in the contract will result in an additional charge of double the daily rental price. In the event of non-return, the lessor may take immediate possession of the bicycle wherever it is located, without any right to claim by the lessee. If the lessee returns the rental bicycle before the agreed date, the lessor reserves the right not to refund the rental for the unused days.

   Reservations already paid can be canceled without charge up to 48 hours before the rental begins. Cancellations communicated 24 hours in advance will incur a penalty of 50% of the reservation amount. Cancellations made with less than 24 hours notice are non-refundable.

2. The bicycle is delivered in perfect working condition, with all accessories and approved equipment. The lessee must return the equipment complete and in the same condition as it was received. Any claim regarding the condition of the bicycle must be made at the time of delivery. The cost of repairing or replacing the bicycle and/or equipment will be borne by the lessee, who must inform the lessor of any damage to the equipment or its malfunction.

3. The lessee is obliged to take the necessary measures to prevent theft, loss, or damage to the bicycle and the rented equipment. If any of these incidents occur during the rental period, the client/lessee is solely responsible and must immediately assume all replacement costs, paying the full retail or market value of the item.

   For these purposes, the client/lessee authorizes the company to charge their credit card for the amount of any damage to the bicycles, and in the case of theft or loss, for the retail or market value of the item.

   At the end of the rental period, the lessor will determine the conditions for returning the rented equipment and assess any losses or damages incurred.

4. The bicycle rental does not include damage insurance, so the lessee is responsible for all material or personal damages they may suffer.

5. The lessee declares to be over 18 years of age and in full physical and mental condition. They also declare to be in perfect health, possess the necessary knowledge and experience to use the rented equipment, and assume the risk of carrying out this activity at their own risk.

   The lessee declares to inform the company of any medical or psychological risks that may affect them. The company will not be liable for any accidents, material or personal damages that the lessee may suffer.

6. At this time, the lessee provides the lessor with a deposit by credit card or cash, which will serve to cover any damages caused to the bicycle or rented equipment. This deposit will be refunded at the end of the contract.

   In the event of an accident, damage, loss, or theft of the bicycle, the lessee is obliged to notify BANANABIKECANARIAS immediately at the provided contact telephone number, forfeiting all rights to request a refund of the deposit, and any refund or compensation for the unused rental days. In addition, they must compensate the lessor with the amount agreed between both parties, as referred to in section 3.

   The use of the bicycle is exclusive to the lessee, unless BANANABIKECANARIAS is informed of its use by third parties, who will be identified in an annex to this contract. The lessee assumes responsibility for the actions of these third parties and for informing them about the conditions of this contract.

   The lessee may not assign, sell, mortgage, exchange, or sublet the bicycle or any part thereof, as well as the tools and elements provided with it.

7. The inappropriate use of the bicycle is prohibited. The installation of accessories or parts on the rented bicycle is only authorized if they are installed and uninstalled by BANANABIKECANARIAS mechanical personnel.

   Likewise, it is prohibited to transport the bicycle outside the island where it is delivered without prior authorization from the lessor, as well as to use the rented bicycle in amateur or professional competitions.

   It is the responsibility of the lessee and their companion(s) to comply with Spanish traffic regulations. The use of a helmet is mandatory when riding outside urban areas, and it is mandatory to have front and rear lights when riding through tunnels.

8. The data provided by the client will be used exclusively for the correct provision of the contracted service. In accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, they ¹ may request access, rectification, cancellation, or opposition through any means of communication with the lessor.  

9. The client declares to have read, listened, understood, and asked, in case of doubt, about the specific use of the rented equipment and the basic safety, conduct, and environmental respect advice provided by the organization at the time of delivery of the rented equipment.

10. This contract is governed by Spanish law, and the client accepts its terms and conditions. The signed conditions apply to all services provided by BANANABIKECANARIAS. Any disputes that may arise during the term of this contract will be resolved by the Courts and Tribunals of Las Palmas de Gran Canaria, to which the parties submit.

I have read and fully understood the terms of the contract and agree to all points.
